An employer is liable for state unemployment tax until a written application for termination is filed, or if TWC elects to terminate coverage.
A business that did not have regular, domestic or agricultural employment during the preceding year may file for termination of coverage because the business would not have met the necessary criteria to be subject to the Texas Unemployment Compensation Act (TUCA) during that year.
The application must be filed between January 1st and March 31st of the year for which termination is requested. Employers cease to be liable as of January 1st of the request year, once the application is approved. An account terminated at the employer’s request is terminated under Sec 206.004 (a) (1) of TUCA.
