Proposed rules and rule reviews the Commission has approved for publication in the Texas Register for a 30-day public comment period.

On June 23, 2026, the Commission approved the following:

Proposed Rule – Chapter 853 Independent Living Services for Older Individuals Who Are Blind

TWC proposes amendments to 40 Texas Administrative Code (TAC), Chapter 853, Independent Living Services for Older Individuals Who Are Blind, to align rules with the updated OIB policy manual and federal regulations.

Proposed Rule – Chapter 858 Procurement and Contract Management Requirements for Purchase of Goods and Services for Vocational Rehabilitation Services

TWC proposes amendments to 40 TAC, Chapter 858, Procurement and Contract Management Requirements for Purchase of Goods and Services for Vocational Rehabilitation Services, to set forth clear guidelines for a fair and consistent recoupment system for the VR program and contractors.

Please submit comments on the proposed Chapter 853 and 858 rules to TWCPolicyComments@twc.texas.gov by August 10, 2026.

On June 2, 2026, the Commission approved the following:

Proposed Rule – Chapter 815 Unemployment Insurance

TWC proposes amendments to 40 Texas Administrative Code, Chapter 815, Unemployment Insurance, to establish by rule a Commission precedent relating to Good Cause for a petitioner's failure to appear at an Unemployment Benefits Appeal Hearing.

Please submit comments on the proposed Chapter 815 rules to TWCPolicyComments@twc.texas.gov by July 20, 2026.

On May 19, 2026, the Commission approved the following:

Proposed Rule – Chapter 809 Child Care Services

TWC proposes amendments to 40 Texas Administrative Code (TAC), Child Care Services, to streamline certain rules, simplify Texas Rising Star parameters, and make programmatic improvements; and to review rules in accordance with Texas Government Code, §2001.039.

Please submit comments on the proposed Chapter 809 rules to TWCPolicyComments@twc.texas.gov by July 6, 2026.

On April 28, 2026, the Commission approved the following proposed rule reviews for 40 Texas Administrative Code (TAC): 

--Chapter 808, Youth Driver Education Funding Program

--Chapter 821, Texas Payday Rules

--Chapter 835, Self-Sufficiency Fund

--Chapter 849, Employment and Training Services for Dislocated Workers Eligible for Trade Benefits

--Chapter 850, Vocational Rehabilitation Services Administrative Rules and Procedures

Proposed Rule Reviews – Chapters 808, 821, 835, 849, 850

Pursuant to Texas Government Code, §2001.039, TWC proposes to review the rules under 40 TAC Chapter 808, Chapter 821, Chapter 835, Chapter 849, and Chapter 850.

The proposed rule reviews will be published in the May 8, 2026, issue of the Texas Register for a 30-day public comment period.

On April 14, 2026, the Commission approved the following:

Proposed Rule – Chapter 804 Jobs and Education for Texans (JET) Grant Program 

TWC proposes amendments to 40 Texas Administrative Code (TAC), Chapter 804, Jobs and Education for Texans (JET) Grant Program, to implement Senate Bill 1728, 89th Texas Legislature, Regular Session, 2025.

Proposed Rule – Chapter 815 Unemployment Insurance

TWC proposes amendments to 40 TAC Chapter 815, Unemployment Insurance, to implement House Bill 3698, 89th Texas Legislature, Regular Session, 2025, relating to claimant participation in reemployment services as a condition of eligibility for unemployment benefits.

Please submit comments on the proposed Chapter 804 and Chapter 815 rules to TWCPolicyComments@twc.texas.gov by June 1, 2026.

On March 3, 2026, the Commission approved the following:

Proposed Rules – Chapter 812 Rural Workforce Development Grant Program

TWC proposes new 40 TAC Chapter 812, Rural Workforce Development Grant Program, to implement Senate Bill 2448, 89th Texas Legislature, Regular Session.

Proposed Rules – Chapter 814 Advanced Nuclear Energy Workforce Development Program

TWC proposes new 40 TAC Chapter 814, Advanced Nuclear Energy Workforce Development Program, to implement Senate Bill 1535, 89th Texas Legislature, Regular Session.

Please submit comments on the Ch. 812 and Ch. 814 proposed rules to TWCPolicyComments@twc.texas.gov by April 20, 2026.

Adopted rules are rules that the Commission has adopted and published as final in the Texas Register.

On June 9, 2026, the Commission adopted the following:

Adopted Rule – Chapter 800 General Administration

The Texas Workforce Commission (TWC) adopts amendments to 40 Texas Administrative Code (TAC), Chapter 800, General Administration, related to the duration of advisory committees, previously published for public comment in the April 10, 2026, issue of the Texas Register (51 TexReg 2344).

Adopted Rule – Chapter 806 Purchases of Products and Services from People with Disabilities

TWC adopts amendments to 40 TAC Chapter 806, Purchases of Products and Services from People with Disabilities, related to the repeal of Subchapter J, Transition and Retention Plans, to remove expired rules, previously published for public comment in the April 10, 2026, issue of the Texas Register (51 TexReg 2346).

Adopted Rule – Chapter 838 Texas Industry-Recognized Apprenticeship Grant Program

TWC adopts amendments to 40 TAC Chapter 838, Texas Industry-Recognized Apprenticeship Grant Program, to implement House Bill 3260, 89th Texas Legislature, Regular Session, 2025, previously published for public comment in the February 20, 2026, issue of the Texas Register (51 TexReg 1034).

The adopted Chapter 800, Chapter 806, and Chapter 838 rules will be effective on June 29, 2026.
