Proposed rules and rule reviews the Commission has approved for publication in the Texas Register for a 30-day public comment period.

On August 11, 2026, the Commission approved the following: 

Proposed Rule – Chapter 842 WIOA Nondiscrimination and Equal Opportunity

TWC proposes amendments to 40 Texas Administrative Code (TAC), Chapter 842, WIOA Nondiscrimination and Equal Opportunity, to conform rules with the recission of a federal regulation.

Please submit comments on the proposed Chapter 842 rules to TWCPolicyComments@twc.texas.gov by September 28, 2026.

Proposed Rule Reviews – Chapters 801, 803, 805, 815, 839

Pursuant to Texas Government Code, §2001.039, TWC proposes to review the following rules under 40 TAC:

--Chapter 801, Local Workforce Development Boards

--Chapter 803, Skills Development Fund

--Chapter 805, Adult Education and Literacy

--Chapter 815, Unemployment Insurance

--Chapter 839, Apprenticeship Programs - Additional

On July 27, 2026, the Commission approved the following:

Proposed Rule – Chapter 800 General Administration

TWC proposes amendments to 40 Texas Administrative Code (TAC), Chapter 800, General Administration, to make technical, clarifying, and conforming updates throughout the chapter, including the repeal of obsolete rules.

Please submit comments on the proposed Chapter 800 rules to TWCPolicyComments@twc.texas.gov by September 7, 2026.

On July 21, 2026, the Commission approved the following:

Proposed Rule – Chapter 815 Unemployment Insurance

TWC proposes amendments to 40 Texas Administrative Code (TAC), Chapter 815, Unemployment Insurance, to clarify change of address notification and notice delivery requirements, Commission hearing procedures, and approved training guidelines; and update definitions and federal regulatory references.

Proposed Rule – Chapter 815 Unemployment Insurance

TWC proposes amendments to 40 TAC Chapter 815, Unemployment Insurance, to incorporate new employer wage record reporting data elements required for implementation of Senate Bill 1786, House Bill (HB) 2, and HB 120, 89th Texas Legislature, Regular Session, 2025.

Please submit comments on both of the proposed Chapter 815 rules to TWCPolicyComments@twc.texas.gov by September 7, 2026.

On June 23, 2026, the Commission approved the following:

Proposed Rule – Chapter 853 Independent Living Services for Older Individuals Who Are Blind

TWC proposes amendments to 40 Texas Administrative Code (TAC), Chapter 853, Independent Living Services for Older Individuals Who Are Blind, to align rules with the updated OIB policy manual and federal regulations.

Proposed Rule – Chapter 858 Procurement and Contract Management Requirements for Purchase of Goods and Services for Vocational Rehabilitation Services

TWC proposes amendments to 40 TAC, Chapter 858, Procurement and Contract Management Requirements for Purchase of Goods and Services for Vocational Rehabilitation Services, to set forth clear guidelines for a fair and consistent recoupment system for the VR program and contractors.

Please submit comments on the proposed Chapter 853 and 858 rules to TWCPolicyComments@twc.texas.gov by August 10, 2026.

On May 19, 2026, the Commission approved the following:

Proposed Rule – Chapter 809 Child Care Services

TWC proposes amendments to 40 Texas Administrative Code (TAC), Child Care Services, to streamline certain rules, simplify Texas Rising Star parameters, and make programmatic improvements; and to review rules in accordance with Texas Government Code, §2001.039.

Please submit comments on the proposed Chapter 809 rules to TWCPolicyComments@twc.texas.gov by July 6, 2026.

On April 28, 2026, the Commission approved the following proposed rule reviews for 40 Texas Administrative Code (TAC): 

--Chapter 808, Youth Driver Education Funding Program

--Chapter 821, Texas Payday Rules

--Chapter 835, Self-Sufficiency Fund

--Chapter 849, Employment and Training Services for Dislocated Workers Eligible for Trade Benefits

--Chapter 850, Vocational Rehabilitation Services Administrative Rules and Procedures

Proposed Rule Reviews – Chapters 808, 821, 835, 849, 850

Pursuant to Texas Government Code, §2001.039, TWC proposes to review the rules under 40 TAC Chapter 808, Chapter 821, Chapter 835, Chapter 849, and Chapter 850.

The proposed rule reviews will be published in the May 8, 2026, issue of the Texas Register for a 30-day public comment period.

On April 14, 2026, the Commission approved the following:

Proposed Rule – Chapter 815 Unemployment Insurance

TWC proposes amendments to 40 TAC Chapter 815, Unemployment Insurance, to implement House Bill 3698, 89th Texas Legislature, Regular Session, 2025, relating to claimant participation in reemployment services as a condition of eligibility for unemployment benefits.

Please submit comments on the proposed Chapter 804 and Chapter 815 rules to TWCPolicyComments@twc.texas.gov by June 1, 2026.

On August 18, 2026, the Commission adopted the following: 

Adopted Rule – Chapter 815 Unemployment Insurance

The Texas Workforce Commission adopts amendments to 40 Texas Administrative Code, Chapter 815, Unemployment Insurance, to establish by rule a Commission precedent relating to Good Cause for a petitioner's failure to appear at an Unemployment Benefits Appeal Hearing, previously published for public comment in the June 19, 2026, issue of the Texas Register (51 TexReg 4006).

The adopted Chapter 815 rules will be effective on September 7, 2026.

Adopted Rule – Chapter 812 Rural Workforce Development Grant Program

TWC adopts amendments to 40 TAC, Chapter 812, Rural Workforce Development Grant Program, to implement Senate Bill 2448, 89th Texas Legislature, Regular Session, previously published for public comment in the March 20, 2026, issue of the Texas Register (51 TexReg 1802).

Adopted Rule – Chapter 814 Advanced Nuclear Energy Workforce Development Program 

TWC adopts amendments to 40 TAC, Chapter 814, Advanced Nuclear Energy Workforce Development Program, to implement Senate Bill 1535, 89th Texas Legislature, Regular Session, previously published for public comment in the March 20, 2026, issue of the Texas Register (51 TexReg 1805).

The adopted Chapter 804, 812, and 814 rules will be effective on August 16, 2026.

On July 21, 2026, the Commission adopted the following:

Adopted Rule – Chapter 815 Unemployment Insurance

TWC adopts amendments to 40 TAC, Chapter 815, Unemployment Insurance, to implement House Bill 3698, 89th Texas Legislature, Regular Session, 2025, relating to claimant participation in reemployment services as a condition of eligibility for unemployment benefits, previously published for public comment in the May 1, 2026, issue of the Texas Register (51 TexReg 2893).
