Comment on Proposed Rules
Proposed rules are published in the Texas Register on the second Friday following the Commission's approval of the proposed rules. Publication in the Texas Register officially begins the 30-day period for the public to comment on the proposed rules. However, TWC posts proposed rules on its website soon after the Commission's approval. This allows the public an opportunity to review and comment on proposals before publication in the Texas Register.
TWC accepts comments via email. Please see the Proposed and Recently Adopted Rules page for any current proposed rules and the email address for submitting comments.
When submitting comments, please include the chapter number and rule section(s) for which you are commenting. Comments should be specific and may be in support of or opposition to any part of the proposed rule.
Petition TWC for Rulemaking
A resident of Texas or a business entity, governmental subdivision, or public or private organization located in Texas that is not a state agency can petition the Commission for the adoption of a rule, as mandated by Texas Government Code, §2001.021.
A written petition must be submitted to TWC's Office of General Counsel and include:
- the petitioner's name and address, complete mailing address, and signature;
- an explanation and justification of the proposed rule, including a concise statement of the relevant background information necessary to understand the need for the rule, the existing problem that the proposed rule is intended to correct, and the proposed rule's foreseeable effects;
- the full text of the proposed rule including, if applicable, all changes to any existing rule and a reference to the existing rule including its title, chapter and section number; and
- a statement of the statutory or other authority for making the proposed rule change.
