Pending Proposed Rules, Rule Reviews, and State Plans

When TWC approves policy concepts, proposed rules, rule reviews, and state plans, the approved documents are posted below for comment.

On August 23, 2022, the Commission approved the following:

Proposed Rules - Chapter 801, Local Workforce Development Boards PDF
The amendment to 40 TAC Chapter 801 is proposed to align rules with the Workforce Innovation and Opportunity Act, including statutorily required Board partners; implement Senate Bill 1, Article VII, Rider 46, 87th Texas Legislature, Regular Session, relating to Digital Skill Building; and include Financial Literacy Training in accordance with Texas Labor Code, §302.0027.

Proposed Rules - Chapter 803, Skills Development Fund PDF
The amendment to 40 TAC Chapter 803 is proposed to streamline the Skills Development Fund grant proposal and approval process.

Proposed Rules - Chapter 821, Texas Payday Rules PDF
The amendment to 40 TAC Chapter 821 is proposed to allow TWC's Labor Law Department to issue corrected determinations.

On August 16, 2022, the Commission approved the following:

Proposed Rules - Chapter 850, Vocational Rehabilitation Services Administrative Rules and ProceduresPDF
Proposed Rules - Chapter 856, Vocational Rehabilitation ServicesPDF
The amendment to 40 TAC Chapter 850 is proposed to add an administrative rule that is required by Texas Labor Code, §352.104; and amendments to both 40 TAC Chapter 850 and Chapter 856 are proposed to clarify existing rule language to improve program service delivery, consistency, and efficiency.

On August 9, 2022, the Commission approved the following:

Proposed Rules - Chapter 800, General AdministrationPDF
The amendment to 40 TAC Chapter 800 proposes new Subchapter M, Tax Refund for Wages Paid to Employee Receiving Financial Assistance, to establish administrative rules that implement Texas Labor Code, Chapter 301, Subchapter H. 
 
Proposed Rules - Chapter 819, Texas Workforce Commission Civil Rights DivisionPDF
The amendment to 40 TAC Chapter 819 is proposed to implement House Bill 21 and Senate Bill 45, 87th Texas Legislature, Regular Session, relating to sexual harassment complaints filed against employers

On July 26, 2022, the Commission approved the following:

Proposed Rules - Chapter 815, Unemployment InsurancePDF
The amendment to 40 TAC Chapter 815 is proposed to add new Subchapter H, Collection Action, to implement Senate Bill 695, 87th Texas Legislature, Regular Session.

On July 12, 2022, the Commission approved the following:

Proposed Rules - Chapter 807, Career Schools and CollegesPDF
The amendments to Chapter 807 are proposed to implement House Bill 33, 87th Texas Legislature, Regular Session; clarify language; and streamline processes.

Please submit comments on the proposed Ch. 807 rules to TWCPolicyComments@twc.texas.gov by August 29, 2022.


On July 5, 2022, the Commission approved the following:

Proposed Rules - Chapter 800, General AdministrationPDF
Proposed Rules - Chapter 805, Adult Education and LiteracyPDF

The amendments to 40 TAC Chapter 800 and Chapter 805 are proposed to allow the Commission flexibility in addressing deobligated grant funds and clarify Adult Education and Family Literacy Act program requirements.
